Commercial HVAC Requirements Before Building Occupancy
If an inspector says the economizer or fresh-air system must work before a business can occupy a building, treat that as a specific ventilation and project-closeout problem—not simply an air-conditioning repair.
The fastest useful response is to get the correction in writing, identify the rooftop equipment and approved design, and have the relevant outside-air components evaluated. A mechanical contractor can inspect and repair equipment within the agreed scope. A design professional may need to establish the design requirements; the code official or enforcing authority makes the approval decision.
First: get the exact correction, not a paraphrase
“The inspector said we need fresh air” is a starting point, but it is not enough to price or complete the work. Ask for the written correction, inspection report, or plan-review note. The difference matters:
- A damper may not open.
- An actuator or linkage may not move the blades.
- Sensors or controls may not complete the intended sequence.
- The minimum outside-air position may be unknown or incorrectly set.
- The outdoor-air hood, screen, or filter may be obstructed.
- Required airflow may not have been measured or documented.
- The equipment may not match the approved plans or current use of the space.
Those conditions do not all have the same solution.
Who confirms the approvals needed before occupancy?
Ask the building department responsible for the property which inspections, permits and approvals apply to the planned use. Send the written HVAC correction to the contractor and project designer so the response addresses the actual requirement.

Ventilation is not proven by a working thermostat
A packaged rooftop unit may have several related but distinct functions:
- heating;
- mechanical cooling;
- supply-air movement;
- return-air movement;
- outdoor-air intake;
- economizer cooling;
- relief or exhaust coordination;
- occupancy schedules and control sequences.
The compressor can run and the space can feel cool even when an outside-air damper, actuator, sensor, or control is not operating as intended. That is why an occupancy-related ventilation concern needs more than a temperature check.
What determines how much outdoor air is required?
There is no single commercial “fresh air” number. The applicable ventilation design can depend on factors that include:
- the occupancy classification or use of the space;
- the net occupiable floor area;
- the expected population;
- the applicable people and area outdoor-air rates;
- air-distribution effectiveness;
- the type and configuration of the ventilation system;
- approved project documents and any applicable local or project-specific requirements.
That calculation is different from opening a damper to an arbitrary percentage. A damper position also does not by itself prove the actual outdoor airflow delivered to the breathing zone.

What an RTU economizer does
An air-side economizer coordinates outdoor-air and return-air dampers. When outdoor conditions are suitable, it can use more outdoor air to reduce mechanical cooling. The economizer assembly may also participate in maintaining the unit’s minimum outdoor-air setting during occupied periods.
Common components include dampers, blades, linkage, an actuator or motor, temperature or enthalpy sensors, wiring, and an economizer controller or unit control board. The exact sequence depends on the equipment and control design.

What a contractor can inspect
The useful scope depends on the correction and the unit, but it may include:
- Confirming the correct rooftop unit and collecting model/control information.
- Inspecting the outdoor-air hood, screens, filters, dampers, linkage, and cabinet.
- Observing or commanding damper travel when the equipment allows safe testing.
- Checking actuator, sensor, control, and wiring conditions.
- Reviewing occupied/unoccupied operation and the minimum-air setup.
- Comparing the observed system with available manufacturer documents and approved project information.
- Identifying whether airflow measurement, balancing, design input, a permit, or a control specialist is required.
- Documenting what was observed and what remains outside the contractor’s scope.

What if the rooftop unit is too old to correct economically?
An older RTU is not automatically a replacement. Some systems can be repaired with a compatible actuator, control, sensor, linkage, damper work, or a properly selected retrofit. Other systems have multiple limitations: damaged cabinet sections, obsolete controls, unavailable parts, repeated heating or cooling failures, refrigerant concerns, poor airflow, or a changed building use.
The comparison should address:
- the exact ventilation correction;
- condition of the full unit, not only the economizer;
- parts and controls compatibility;
- expected repair life;
- replacement lead time and roof logistics;
- electrical, curb, duct, gas, control, permit, and design impacts;
- operating interruption and reinspection timing.

What to send before requesting service
Sending the right information can prevent an unproductive first visit:
- the full written inspection or correction note;
- site address and responsible contact;
- roof-access method and site safety requirements;
- equipment model and serial photos for private service use;
- control-panel and economizer photos, if safely available;
- approved mechanical plans or equipment schedules;
- permit and inspector contact information, when applicable;
- intended business use and expected occupant count;
- deadline, stated as a scheduling need rather than an assumed guarantee.
Protect equipment serial numbers and property details in anything posted publicly. Send them through the private service process.
Who decides whether the correction is enough?
The contractor can diagnose equipment, propose work, complete an approved mechanical scope, and provide service documentation. The design professional may establish or review design requirements. The code official or enforcing authority determines final acceptance.
That distinction protects the business owner from a costly assumption. It also keeps the repair focused on the actual written issue.
Frequently asked questions
Can a failed economizer delay occupancy?
It can become part of an unresolved mechanical or ventilation correction when the approved system depends on it. The responsible authority determines whether that correction affects occupancy approval.
Is the economizer the same as the fresh-air system?
Not exactly. An economizer is a controlled outdoor-air and return-air damper system that can provide outdoor-air cooling. It may also be involved in minimum ventilation air, but the entire ventilation path and control sequence determine whether outdoor air is delivered as intended.
Can you set the fresh-air damper by percentage?
A damper position may be part of the control setup, but a percentage alone does not establish the required CFM or prove delivery to the occupied zone. Use the approved design, applicable calculation, and measurement method.
Does an old rooftop unit have to be replaced?
Not solely because it is old. Repairability, component condition, compatible parts, complete-unit condition, project requirements, and lifecycle cost should guide the decision.
Can a contractor guarantee the certificate of occupancy?
No. Final acceptance belongs to the code official or enforcing authority.
